BOISE – The IFPC Legal Center last week secured a monetary settlement for “Jane Doe,” a high school girl who sued Boise School District for giving a biological male express permission to use the girls’ restrooms as part of his “gender support plan.”
The lawsuit is the first to be brought under the Idaho school bathroom law, which requires public schools to maintain separate bathrooms, locker rooms, and changing areas for biological males and females. It is also possibly the first case in the nation successfully brought by a female victim who encountered a biological male in her school bathroom.
The Idaho school bathroom law was researched, drafted, and championed by Idaho Family Policy Center and sponsored by Rep. Ted Hill (R-Eagle) and Sen. Ben Adams (R-Nampa) in 2023.
The insurance company for the Boise School District agreed to settle the claims brought by Jane Doe, paying out $34,000 in damages and attorney fees.
The settlement comes on the heels of Ada County District Court Judge Norton denying a motion from Boise School District to dismiss the lawsuit earlier this summer.
During the hearing on the motion to dismiss, Boise School District admitted to Judge Norton that it could have changed its bathroom policy to comply with the law, but argued that wasn’t required because the Ninth Circuit had issued a temporary stay blocking enforcement of the law while it considered whether the law was constitutional. Because the Ninth Circuit ultimately upheld the law, Judge Norton concluded that Boise School District could not use the temporary stay to justify its violation of the school bathroom law.

Last year our daughter was subjected to having to endure a breach of her privacy at Boise High School. Not once but twice she encountered a male student in the female bathroom. When she reported the incidents to school staff, she was told that it was their policy to allow males who identify as female to use the bathroom of their choice. Their lack of action forced us to seek help from someone outside the school system. No girl should ever have to go through what our daughter experienced. We were so happy to find the IFPC Legal Center. Their hard work helped us get justice, and we can’t thank them enough for their support throughout this case.
