PRESS RELEASE: New Library Porn Bill Sent to Governor for Signature

BOISE, IDAHO – Idaho House Bill 710, called the Children’s School and Library Protection Act, is now on its way to Governor Brad Little’s desk after receiving approval from both the House and Senate.

The Children’s School and Library Protection Act creates civil liability for public schools and community libraries that fail to restrict minor children’s access to pornographic materials.

House Bill 710 largely utilizes model language drafted by Idaho Family Policy Center last year. It ditches the unconstitutional language and cumbersome administrative review process that characterized Senate Bill 1289, which died on the Senate floor last month.

Last year, Idaho Family Policy Center released a report identifying more than 55 public schools and community libraries statewide that make pornographic material available to minor children.

More than 74% of likely Idaho voters believe that public schools and community libraries should keep pornographic materials away from minor children, according to statewide public opinion polling commissioned last year by Idaho Family Policy Center.

Pornography has no place in schools or public libraries – period. Yet many public schools and community libraries exploit an existing loophole in Idaho obscenity law that allows them to promote or distribute pornographic materials to minor children.

No child should encounter sexually explicit books at taxpayer-funded schools or community libraries. We’re grateful that state legislators have taken another swing at this documented problem—and we’re hopeful that the Governor will sign this legislation into law.
