It’s Official: We’re Suing Boise School District

It’s time to enforce the law: We’re taking on the Boise School District for violating the school bathroom law and failing to protect its female students.

Last week, my team at the IFPC Legal Center filed a lawsuit against Boise School District on behalf of a high school girl who twice encountered a biological male in the girls’ restroom.

During one of these occasions, she heard deep grunting sounds coming from the adjacent stall—and when she looked down, she saw his shoes pointing towards her. She was obviously traumatized by the experience.

But it gets worse: School administrators ignored her concerns, instead reaffirming their express permission to allow the biological male to use the girls’ bathroom as part of his “gender support plan.”

As you might remember, the Idaho Family Policy Center policy team researched, drafted, and championed the school bathroom law during the 2023 legislative session.

But Boise High School decided to violate that law—and we intend to hold them accountable.

You might have seen the headlines already. Since the lawsuit hit the news, I’ve had the chance to tell our client’s story, explaining why this should never happen to any other young girl. You can find some of those interviews below.

“Idaho students should feel safe in Idaho schools, and nowhere more than in the most private spaces like restrooms and locker rooms,” said Caleb Pirc, Director of the IFPC Legal Center. “But rather than protecting its students’ safety and privacy, Boise High School facilitated the violation of our client’s privacy.”

The complaint alleges Jane Doe suffered significant emotional and psychological distress. It also says her parents ultimately withdrew her from Boise High School because of the school administration’s failure to protect her privacy and because of fear of harassment from other students.

 

The lawsuit seeks statutory damages and damages for psychological and emotional harm.

 

Idaho’s Senate Bill 1100, enacted in 2023, established a statewide policy requiring public schools to maintain separate restrooms and changing facilities based on biological sex. The Idaho Family Policy Center said it researched, drafted and championed the bill, and said statewide polling showed the measure was supported by more than 71% of Idaho voters.

The Idaho Family Policy Center has officially filed suit on behalf of a female student at Boise High School, alleging that both the high school and the district failed to create a safe learning environment by allowing a “biological male” to use the women’s restroom.
