We just keep winning—and nobody won more this week than girls in every public school across the state of Idaho.
Here’s the great news: A federal court has dismissed the legal challenge against our law protecting girls in school bathrooms and locker rooms!
This outcome ends the three-year legal battle that began shortly after Senate Bill 1100 – which was drafted and championed by Idaho Family Policy Center and sponsored by Sen. Ben Adams (R-Nampa) and Rep. Ted Hill (R-Eagle) – went into effect in July 2023.
Federal courts had already decisively shot down attempts by an activist LGBT group to block the law in recent months. U.S. District Judge Nye, for one, didn’t mince words:
Separating restrooms by biological sex has been common for centuries. And for good reason—there are biological differences between men and women. Those biological differences are deserving of privacy and S.B. 1100’s [separation] of restrooms based on sex is related to that interest.
The District Court decision was later affirmed by the U.S. Ninth Circuit Court of Appeals, which found that Idaho’s goal of safeguarding the privacy of students is an important government objective.
This outcome confirms what we’ve been saying all along: There is nothing unconstitutional about a state law protecting the privacy and safety of girls.

We’re also grateful to God that this litigation is finally drawing to a close—and that Idaho parents can sleep well knowing that their daughters are safe in school bathrooms and locker rooms!
