BIG NEWS: We’ve had a victory in the courts!

I’ve got exciting news to share: Our school bathroom law protecting the privacy and safety of all students is back in effect after more than a year of being blocked by a federal appeals court!

Senate Bill 1100, which was signed into law by Gov. Brad Little in 2023, ensures that public schools keep separate bathrooms, locker rooms, and shower facilities for biological males and biological females. The law was drafted and championed by Idaho Family Policy Center and sponsored by Rep. Ted Hill (R-Eagle) and Sen. Ben Adams (R-Nampa). 

The law went into effect on July 1, 2023—but it was blocked by the Ninth Circuit Court of Appeals in October 2023 after gender-confused students sued state education officials, claiming that the law discriminated against the students on the basis of their transgender status.

In its opinion, the 9th Circuit panel affirmed that the students are “unlikely to succeed on the merits” of their claims.

The judges recognized that our law promotes important governmental interests like ensuring “students [aren’t exposed] to the unclothed bodies of students of the opposite sex” and “protecting students from having to expose their own unclothed bodies to students of the opposite sex.”

We praise God that Idaho law once again protects the privacy, safety, and dignity of all students—especially girls. These protections are critically important in liberal parts of the state like the Boise School District, which continues to make headlines for allowing biological males to use locker rooms and shower areas designated for girls.

In a press release, Attorney General Raul Labrador celebrated the panel’s decision:

“Every day, we see more examples of the harms of gender ideology, particularly to women and girls.  We applaud the court’s decision to allow our State Board of Education to continue its job of preserving each student’s privacy, dignity, and safety and providing a quality education for Idaho’s children.”

I’d especially like to extend our gratitude to Attorney General Raul Labrador and our national partner, Alliance Defending Freedom, for their exceptional work in defending our law so far. 

But our work is far from over. Without your support, Senate Bill 1100 – which was researched, drafted, and championed by Idaho Family Policy Center – wouldn’t be law today.
